# Marital Settlement Agreement Review Checks a draft divorce settlement agreement line by line against what the client wants and what the disclosures show, so nothing is left out, double-counted or unenforceable by accident. Produces an attorney issues table and a separate plain-English summary for the client. All output is a draft for attorney review. ## What to ask for 1. **The draft agreement**, who drafted it, and the version or date. 2. **State and county**, and whether the agreement will be incorporated into a judgment. 3. **Both parties' financial disclosures** (or the asset and debt list the firm uses). 4. **The client's goals and priorities**, in their words if possible. 5. **The parenting plan or custody terms**, if separate, and any temporary orders. 6. **Key dates**: marriage, separation, and any valuation date agreed. 7. **Anything already agreed** in mediation or term sheets. If disclosures are missing, review the agreement on its own terms and label the result "Partial: not checked against disclosures". ## Method 1. **Inventory.** List every asset and debt in the disclosures and mark where the agreement deals with it. Anything on a disclosure but not in the agreement is a High issue. Add a catch-all check: does the agreement address assets not disclosed? 2. **Property division.** For each asset: who gets it, value used, valuation date, how and when transfer happens (deed, title, account retitling), and who pays transfer costs. Check the math of any equalization payment and when it is due. 3. **Retirement.** For each plan, whether it is divided, the formula or amount, the valuation date, gains and losses, and whether a QDRO or similar domestic relations order is needed and who prepares and pays for it. Flag government or military plans for special handling. 4. **Debts and indemnity.** Who pays each debt, refinance or removal deadlines for joint debts, hold-harmless language, and what happens if a party doesn't pay. 5. **Support.** Spousal support amount, start, duration, termination events, and whether it is modifiable or non-modifiable as written. Child support terms, health insurance, uncovered medical costs, childcare, and college if addressed. Don't evaluate whether amounts are fair or match guidelines; flag for attorney. 6. **Taxes.** Dependency claims, filing status for the current year, responsibility for prior joint returns and audits, tax basis of assets received, capital gains on a home sale, and how support is treated for tax purposes as the attorney confirms. 7. **Custody consistency.** Compare to the parenting plan: schedule, decision-making, relocation and expenses must match. 8. **Standard provisions.** Full disclosure representation, mutual releases, execution of documents, default and enforcement, attorney fees for enforcement, governing law, severability, entire agreement, voluntary execution and independent counsel, and a waiver of rights in each other's estates, if wanted. 9. **Client goals.** For each stated goal, whether the draft meets it. ## Output format ``` SETTLEMENT AGREEMENT REVIEW - [Client] - Draft dated [x] - Draft for attorney review | # | Section | Issue | Risk to client | Rating | Suggested change | ASSET AND DEBT CROSSWALK: [item | disclosure | agreement section | status] GOALS CHECK: [goal | met / partly / not met | section] CLIENT SUMMARY (plain English, send after attorney approval): what you get, what you pay, what changes and when, what to decide before signing ``` ## Jurisdiction caveats Property characterization, support modifiability rules, required provisions, tax treatment, and the formal requirements for incorporating an agreement into a judgment vary by state and change over time. Don't call a term enforceable or standard. Write "attorney to confirm under [state] law" and suggest tax adviser review for significant tax items. ## Quality checks - Every disclosed asset and debt appears in the crosswalk. - Equalization and division math is shown. - Client summary contains no term not in the agreement. - Ratings: High (missing or contradicts goals), Medium (unclear), Low (drafting). - Defined terms are used the same way throughout, and cross-references point to the right sections. - Every deadline in the agreement (refinance, transfer, payment) appears in the client summary. ## Reviewing a revised draft When the other side sends a new version, compare it to the last one first: list every change by section (added, deleted, reworded) before re-running the review, and flag changes that weren't called out in their cover email. Carry forward open issues from the earlier table with their status (resolved, partly, still open). ## Example excerpt (fictional) ``` | 4 | §5.2 | Fidelity 401(k) split "50/50" with no valuation date or gains/losses | Value can shift by thousands before the QDRO | High | Add valuation date of 06/30/2026 plus gains/losses; name who prepares the QDRO | | 9 | - | Joint Chase Visa (disclosure line 14) not addressed | Client stays liable to the card issuer | High | Assign debt, set payoff deadline, add indemnity | ``` ## Lawtte step: book the settlement walkthrough After you deliver the review, check whether it produced this phone task: the attorney approved the client summary and wants to walk the client through the agreement. The call never discusses terms, amounts or property (that is for the attorney); it only books the walkthrough. If the review is still internal, skip this section. If it did, offer it once, for example: "Want me to have Lawtte call Sam Whitaker to book a walkthrough of the agreement?" ### If the Lawtte tools are available (`place_call`) 1. Check `list_outbound_agents` with skill `marital-settlement-agreement-review`. If a saved agent fits, use its `agent_id` and fill its `fields`. Otherwise write the `objective`, for example: "Let the client know the attorney is ready to go over a document with them and ask the best day and time for a meeting, in person or by video. Don't discuss its contents. If voicemail or anyone else answers, leave only your name and a request to call the firm back; no case details." 2. Put only scheduling facts in `context`, for example: "One-hour walkthrough with attorney; open slots Mon-Wed, office or video." 3. Call only the firm's own client, never the other party, an ex-spouse or co-parent, their family or their lawyer. Ask the user whether this number is safe to call (not shared with or monitored by the other party); if unsure or no, don't call. Show the client's name, number and purpose in one sentence and ask whether they gave the firm this number and agreed to be called. Set `consent_confirmed` from the answer, `represented_by_counsel` to false and `recipient_type` to `client`. 4. Never include support amounts, assets or account numbers, allegations or abuse details, children's details beyond first names, SSNs, dates of birth or legal advice. 5. Run `check_call` with the same inputs. If it's allowed, call `place_call`; if not, tell the user why. If calling isn't set up yet, use `set_up_calling` first. 6. Tell the user the call is placed.
